Combating the copycats…
They say imitation is the sincerest form of flattery – however, since we began we have faced a steady stream of copycats trying to use our designs and content. It can be an incredibly frustrating time if it happens to your business, so we sat down to discuss our story and hopefully provide you with some reassurance and advice…
The success we have enjoyed at Polygon has been great, but it has also meant that we have become a constant target for imitation. We were aware that other companies would take inspiration from existing brands but we had no idea just how shameless and aggressive the industry can be.
A lot of time and effort went into developing Polygon, from countless late nights to constantly striving to achieve the best product possible. It took an incredible amount of energy to get Polygon from a concept into the fully functional and popular product that it is today.
That’s why it is so disappointing and frustrating to see other companies profiting off all of the hard work that we have put in. We’ve even had our unique video and imagery stolen and rebadged with other branding on it – as most of our videos feature the people that work here, it was a little strange seeing ourselves across different websites!
Don’t get us wrong, it is fair competition to take another product and build upon it, putting your own spin on it. However, we are not seeing that. Instead, we just have brands copy and pasting our products and content!
Ultimately though, we try not to let these things affect us too much and our focus remains on developing our brand and providing our customers with the very best products and services possible.
Like many small businesses, we simply do not have the funds or legal team to track every single organization stealing our property but we know that by continuing to produce innovative design solutions, then over time our brand will fully establish itself.
We’re all very excited about what the future has in store at Polygon and our team is working hard in designing and developing a host of fun and engaging new products.
Our top tips on what to do when your work is used elsewhere
Unfortunately, we’ve become all too familiar with our work being copied. So to help you, we’ve put together our four top tips with what to do when you notice a brand is using your content:
1. Seek legal advice
Our experience has shown that no two situations are the same, so the first thing to do is seek legal advice. It’s also useful to familiarize yourself with the various forms of protection in place to help you:
- Utility patent:
This is used to protect new technologies and concepts.
- Design patent:
This is used to protect the aesthetic of your product.
This is used to protect original works of authorship, including music, images, and copy. Copyright is automatically applied when the work is created and fixed in a tangible form.
2. Contact the platform hosting the content
If you notice your content is being used, contact the platform that it is being hosted on – for example, Amazon or Instagram. Usually if you contact the seller or user directly you will receive no reply, so contacting the host platform is far more effective.
3. Watermark content
This might seem simple, but watermarking your logo over the content helps to protect it and deter others from using it
4. Seek help
Tracking who is using your content is a full-time task but some companies (www.redpoints.com) offer this service for you. They’ll continuously track and protect your brand across the entire internet. It can be expensive, but they do a fantastic job of stopping anyone stealing your content, as well as saving you a lot of time.
